1. Agreement to Terms

Welcome to Ticket Trove Africa. These Terms & Conditions ("Terms") govern your access to and use of our event ticketing platform, website, mobile applications, and services (collectively, the "Platform").

By accessing or using Ticket Trove Africa, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Platform.

Important: These Terms contain provisions that limit our liability and require you to resolve disputes through arbitration on an individual basis, not as part of a class action.


2. Service Description

Ticket Trove Africa is an online ticketing platform that connects event organizers with attendees. Our services include:

  • Online ticket sales and distribution

  • Digital ticket generation and delivery via WhatsApp and email

  • Secure payment processing through M-Pesa

  • QR code verification for event entry

  • Event discovery and browsing

  • Account management for buyers and organizers

Platform Role: Ticket Trove Africa acts as an intermediary platform. We facilitate ticket sales but are not the organizer, producer, or host of events. Event organizers are solely responsible for their events.


3. User Accounts
3.1 Account Creation

To purchase tickets or create events, you must create an account. You agree to:

  • Provide accurate, current, and complete information

  • Maintain and update your information to keep it accurate

  • Keep your password secure and confidential

  • Be at least 18 years old or have parental/guardian consent

  • Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the security of your account. Notify us immediately at support@tickettroveafrica.com if you suspect unauthorized access to your account.

3.3 Account Restrictions

You may not:

  • Create multiple accounts to circumvent restrictions

  • Share your account with others

  • Use another person's account without permission

  • Impersonate any person or entity


4. Ticket Purchase Process
4.1 Browsing and Selection

You can browse events and select tickets based on:

  • Event date, time, and location

  • Ticket type (General Admission, VIP, etc.)

  • Pricing and availability

  • Promo codes and discounts

4.2 Reservation System

When you add tickets to your cart, we reserve them for 15 minutes. During this time:

  • Tickets are temporarily held for you

  • You must complete payment before the reservation expires

  • Expired reservations are automatically released

  • You may manually release reservations by leaving checkout

4.3 Ticket Limits

Event organizers may set per-order limits. Attempting to circumvent these limits may result in order cancellation and account suspension.

4.4 Pricing and Fees

All prices are displayed in Kenyan Shillings (KES) and include:

  • Ticket face value

  • Service fees (if applicable)

  • Applicable taxes

Prices are subject to change until you complete payment. Promotional pricing may have specific terms and conditions.

4.5 Order Confirmation

Once payment is confirmed, you will receive:

  • Order confirmation via email

  • Digital tickets via WhatsApp and email

  • Receipt for your records

  • Access to tickets in your account


5. Payment Terms
5.1 Payment Methods

We currently accept payments via:

  • M-Pesa: Safaricom M-Pesa STK Push (Kenya)

Additional payment methods may be added in the future.

5.2 M-Pesa Payment Process

When paying via M-Pesa:

  • You will receive an STK Push prompt on your phone

  • Enter your M-Pesa PIN to authorize payment

  • Payment confirmation typically takes 10-30 seconds

  • You will receive M-Pesa confirmation SMS from Safaricom

  • Tickets are delivered immediately upon successful payment

5.3 Payment Authorization

By completing payment, you:

  • Authorize us to charge the displayed amount

  • Confirm the order details are correct

  • Accept the event organizer's terms

  • Agree to the refund policy

5.4 Failed Payments

If payment fails:

  • Your reservation may be released after 15 minutes

  • You may retry payment up to 3 times

  • Check your M-Pesa balance and network connection

  • Contact M-Pesa support for payment-related issues

5.5 Payment Disputes

For payment disputes:

  • Contact us at support@tickettroveafrica.com within 48 hours

  • Provide your order ID and M-Pesa transaction code

  • We will investigate and respond within 5 business days

5.6 Currency and Taxes

All transactions are processed in Kenyan Shillings (KES). Prices include applicable taxes unless otherwise stated. We are not responsible for currency exchange rates or international transaction fees.


6. Refunds & Cancellations
6.1 General Refund Policy

Refund eligibility is determined by the event organizer's refund policy. Common policies include:

  • No Refunds: All sales are final

  • Refundable: Refunds available up to a specified date

  • Partial Refund: Refunds minus processing fees

The refund policy is displayed during checkout and in your order confirmation.

6.2 Event Cancellation by Organizer

If an event is cancelled by the organizer:

  • You will be notified via email and WhatsApp

  • Full refunds will be processed within 7-14 business days

  • Refunds are returned to your M-Pesa account

  • Service fees may be retained to cover processing costs

6.3 Event Postponement or Rescheduling

If an event is postponed or rescheduled:

  • Your ticket remains valid for the new date

  • Refunds may be available if you cannot attend the new date

  • Contact the event organizer for specific refund policies

6.4 Requesting a Refund

To request a refund:

  1. Log into your account

  2. Navigate to "My Orders"

  3. Select the order and click "Request Refund"

  4. Provide a reason for the refund request

  5. Submit and await confirmation

6.5 Refund Processing Time

Approved refunds are processed within:

  • M-Pesa refunds: 3-7 business days

  • Bank transfers: 7-14 business days

6.6 Non-Refundable Circumstances

Refunds are not provided for:

  • Change of mind after the refund deadline

  • Failure to attend the event

  • Lost or damaged tickets (we can reissue tickets)

  • Events marked as "No Refunds"

  • Violation of these Terms or event rules


7. Ticket Delivery
7.1 Delivery Methods

Digital tickets are delivered via:

  • WhatsApp: Instant delivery via WhatsApp Business API (primary method)

  • Email: Sent to your registered email address (backup method)

  • Account: Available in your account under "My Tickets"

7.2 Ticket Format

Each ticket includes:

  • Event details (name, date, time, venue)

  • Ticket type and buyer information

  • Unique QR code for entry verification

  • One-Time Password (OTP) for additional security

  • Order ID and ticket number

7.3 Ticket Validity

Your ticket is valid only if:

  • The QR code is scannable and has not been used

  • The OTP is correct (if required)

  • Payment was successfully completed

  • The ticket has not been reported as fraudulent

7.4 Lost or Missing Tickets

If you haven't received your tickets:

  • Check your WhatsApp messages and email spam folder

  • Log into your account to download tickets

  • Contact support@tickettroveafrica.com for ticket reissue

  • Have your order ID ready for verification

7.5 Ticket Transfer

Ticket transfers are subject to event organizer policies. Some events may:

  • Allow ticket transfers (you can reassign tickets)

  • Restrict transfers (tickets are non-transferable)

  • Require ID verification at entry

7.6 Printing and Display

You may:

  • Display tickets on your mobile device

  • Print tickets from the PDF

  • Screenshot tickets (though PDF is recommended)

Important: Do not share your QR code or OTP publicly, as anyone with this information can gain entry.


8. User Conduct and Prohibited Activities

You agree not to:

8.1 Fraudulent Activities
  • Use stolen payment information or fraudulent payment methods

  • Create fake accounts or provide false information

  • Duplicate, forge, or manipulate tickets

  • Engage in ticket scalping or unauthorized resale

8.2 Platform Misuse
  • Use automated tools, bots, or scripts to purchase tickets

  • Circumvent purchase limits or security measures

  • Interfere with the platform's operation or security

  • Attempt to gain unauthorized access to accounts or systems

8.3 Prohibited Content
  • Post illegal, harmful, or offensive content

  • Upload malware, viruses, or malicious code

  • Infringe on intellectual property rights

  • Harass, threaten, or abuse other users

8.4 Consequences of Violations

Violations may result in:

  • Immediate account suspension or termination

  • Order cancellation without refund

  • Permanent ban from the platform

  • Legal action and reporting to authorities


9. Event Organizer Responsibilities

If you are an event organizer using Ticket Trove Africa, you agree to:

9.1 Event Information
  • Provide accurate event details (date, time, venue, description)

  • Update information promptly if changes occur

  • Ensure all promotional materials are truthful

9.2 Event Delivery
  • Host the event as advertised

  • Honor all tickets sold through the platform

  • Provide reasonable accommodation for attendees

  • Comply with local laws, regulations, and permits

9.3 Financial Obligations
  • Pay platform fees as agreed

  • Process refunds per your stated policy

  • Report accurate financial information

9.4 Attendee Data
  • Use attendee data only for event-related purposes

  • Comply with data protection laws

  • Maintain confidentiality of attendee information


10. Limitation of Liability
10.1 Platform Role

Ticket Trove Africa is a platform that facilitates ticket sales. We are not:

  • The organizer, producer, or host of events

  • Responsible for event quality, safety, or legality

  • Liable for event cancellations, changes, or issues

  • Guarantors of event organizer performance

10.2 Service Availability

We strive for uninterrupted service but do not guarantee:

  • 24/7 platform availability

  • Error-free or bug-free operation

  • Compatibility with all devices

  • Uninterrupted ticket delivery

10.3 Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.4 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TICKET TROVE AFRICA SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, or consequential damages

  • Loss of profits, data, or business opportunities

  • Damages exceeding the amount you paid for tickets

  • Third-party actions or content

10.5 Indemnification

You agree to indemnify and hold harmless Ticket Trove Africa, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the platform

  • Your violation of these Terms

  • Your violation of any rights of another party

  • Events you organize through the platform


11. Intellectual Property
11.1 Our Intellectual Property

All content on Ticket Trove Africa, including:

  • Platform design, layout, and functionality

  • Logos, trademarks, and branding

  • Text, graphics, images, and software

  • Code, algorithms, and technology

is owned by Ticket Trove Africa or our licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without written permission.

11.2 User Content

When you create events or upload content, you:

  • Retain ownership of your content

  • Grant us a license to use, display, and distribute your content on the platform

  • Represent that you own or have rights to the content

  • Agree not to upload infringing content

11.3 Copyright Infringement

If you believe content on our platform infringes your copyright, contact us at:

Include:

  • Description of the copyrighted work

  • URL of the infringing content

  • Your contact information

  • Statement of good faith belief

  • Electronic or physical signature


12. Dispute Resolution and Governing Law
12.1 Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.

12.2 Informal Resolution

Before pursuing formal dispute resolution, please contact us at support@tickettroveafrica.com to attempt to resolve the issue amicably. We commit to good-faith efforts to resolve disputes within 30 days.

12.3 Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration under the Arbitration Act of Kenya. The arbitration shall:

  • Be conducted in Nairobi, Kenya

  • Be administered by a qualified arbitrator

  • Be conducted in English

  • Result in a final and binding decision

12.4 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES INDIVIDUALLY AND WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE PROCEEDINGS.


13. Termination
13.1 Termination by You

You may terminate your account at any time by:

  • Contacting support@tickettroveafrica.com

  • Using account deletion in your settings

Upon termination:

  • Your access to the platform will cease

  • Your tickets remain valid for purchased events

  • Some data may be retained as required by law

13.2 Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms

  • You engage in fraudulent activities

  • We are required by law

  • We cease operations

13.3 Effect of Termination

Upon termination, you must:

  • Cease using the platform

  • Delete any downloaded materials

  • Settle any outstanding payments

Sections that should survive termination (including limitation of liability, intellectual property, and dispute resolution) will remain in effect.


14. Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including:

  • Natural disasters (earthquakes, floods, storms)

  • War, terrorism, or civil unrest

  • Government actions or regulations

  • Pandemics or public health emergencies

  • Internet or telecommunications failures

  • Third-party service outages


15. Changes to These Terms

We may update these Terms from time to time. When we make material changes:

  • We will update the "Last Updated" date

  • We will notify you via email or platform notice

  • Changes take effect 30 days after notification

  • Continued use constitutes acceptance of new terms

If you do not agree to the updated Terms, you must stop using the platform.
